Arrested for DUI in Tulsa?
In my experience providing criminal defense strategies for people all across
Oklahoma, I have discovered that out of all the potential criminal violations
on the books, driving under the influence (DUI) may very well be the most
common. The police are so intent on pulling over and citing people with
this crime, even the innocent have been locked up and lost their driving
privileges. For this reason, I have deliberately focused much of my practice
on the defense of those arrested for a DUI. I believe that without steadfast
and tenacious legal counsel present in the courtroom for the defendant,
the criminal justice system feels free to treat and sentence people however
it likes. This is simply not acceptable, and I am honored to be able to
help keep it in check for the benefit of my clients.
DUI defense strategies that I may be able to use include:
Unlawful stop: When a highway patrol officer pulls someone over, they must have valid
reason to do so. In a DUI case, they must have reasonable suspicion to
believe that the driver was intoxicated; the same is true for sobriety
checkpoints along Tulsa and Oklahoma highways. If you were pulled over
unlawfully, the arrest and any evidence gathered from it could be deemed
Unspoken Miranda warning: In addition to needing a valid reason to pull you over in the first place,
your case could be thrown out if the arresting officer never read your
Miranda warning, or rights. “You have the right to remain silent
Unreliable field sobriety tests: Many DUI arrests occur due to the “evidence” the officer collects
while a suspect takes a field sobriety test, such as standing on one leg
or walking a straight line without teetering. Tests like these are infamous
for their unreliability, so much so that you actually have the right to
refuse them without any immediate legal consequence.
Uncalibrated chemical tests: Law enforcement likes to claim that chemical tests – blood, breath,
or alcohol – are infallible since they rely on a computer to generate
a number based on your blood alcohol concentration (BAC) level. Do not
be fooled. If the machines are not calibrated precisely, it can easily
product a result much higher than what is real.
